Problem:

AFL’s client worked at CBS as a contracted video editor. His hard work was praised, and he was assured he would be first in line for an upcoming full-time video editor position. However, Mr. Rhoden wasn’t even considered when the position opened. The position was instead given to a Hispanic woman with considerably less experience. When asked why he hadn’t been considered, the hiring manager said, “We have too many straight, white, men in our department.” AFL’s client did not fit their ideal demographic, and by declining to offer him a position as a video editor, the company made room to hire other candidates that fit their preferred demographic.

Action:

AFL sued CBS, its president Wendy McMahon, and CBS’s parent company, Paramount Global, for violating California’s Fair Employment and Housing Act by unlawfully discriminating against Mr. Rhoden, a decorated U.S. Navy combat veteran, because of his race, sex, age, and military status.

Result:

The case is currently being litigated.
