America First Legal v. United States Department of State et al.

Case Number: 1:24-cv-03113

FOIA Litigation
November 2024
Status: Ongoing
FOIA Litigation

Problem:

America First Legal (AFL) filed a series of letters to the Offices of the Inspector General (IG) in the Department of State, Department of Justice (DOJ), and the Department of Homeland Security (DHS). These actions were focused on exposing and combating the Biden-Harris administration's failure to enforce laws against the foreign-funded and organized pro-Hamas network. AFL has demanded investigations into whether the DOJ, DHS, and State Department have ignored federal crimes and allowed pro-Hamas individuals and organizations to evade legal consequences. AFL also petitioned the DOJ to take action under the Foreign Agent Registration Act (FARA) against several pro-Hamas entities and called for the Department of Education to ensure universities report necessary data on foreign students involved in such activities. After submitting these letters, AFL filed FOIA requests to obtain related records from the federal agencies.

Action:

AFL sued the Department of State for failing to produce the responsive records requested.

Result:

This case is currently being litigated.
