
WASHINGTON, D.C. – America First Legal (AFL) has filed a federal civil rights complaint with the U.S. Department of Health and Human Services (HHS) Office of Civil Rights, formally requesting an investigation into Johnson & Johnson’s (J&J) systemic violations of federal discrimination laws through the company’s unlawful diversity, equity, and inclusion (DEI) policies affecting its entire operations, including in its hiring, promoting, employee training, and clinical trials.
Johnson & Johnson admits, and even boasts on its website and elsewhere, that it knowingly and intentionally uses race, color, national origin, and sex as motivating factors in its employment practices, in violation of Title VII of the Civil Rights Act of 1964 and several Executive Orders. Specifically, Johnson & Johnson:
- Requires its vendors to implement race-conscious hiring practices in their employment practices as a condition of doing business with J&J.
- Illegally tracks its DEI practices through numerical race and sex-based goals, which means quotas, to require each department at the company to meet these benchmarks.
- Uses data to track its talent goals and seeks to hold its leaders accountable to achieve these goals.
- Embeds DEI policies in clinical trials related to immunology, cardiovascular, and oncology, prioritizing these unlawful policies over the law.
J&J does all this despite receiving billions of taxpayer dollars in the form of federal contracts from HHS, the U.S. Department of Defense, and other agencies, all of which require compliance with the federal government’s equal opportunity clause. The evidence shows that J&J systematically and intentionally ignores its compliance obligations under these federal grants and contracts.
“The American people consider Johnson & Johnson a household name, innocently purchasing the J&J brand for their families. Many would be surprised and disappointed to learn that their hard-earned money is being spent on a company that supports discriminatory and woke policies that judge people by their race, color, and gender, which only serves to further the radical left’s political agenda,” said Julie Alexa Strauss, Senior Counsel at America First Legal. “These violations of federal discrimination laws cannot be tolerated. AFL is committed to dismantling these destructive and discriminatory race-based hiring and promotion practices.”
AFL’s letter requests that the Department of Health and Human Services’ Office of Civil Rights initiate an in-depth investigation into Johnson & Johnson’s blatant violations of federal law, including its failure to comply with the equal opportunity terms of federal contracts.
