America First Legal Files Brief at Supreme Court on Behalf of Representative Jim Jordan and 44 Members of Congress About the Federal Government’s Unconstitutional Censorship of Free Speech on Social Media

WASHINGTON, D.C. – Today, America First Legal (AFL), with co-counsel Christopher Mills, filed a brief in the Supreme Court of the United States on behalf of Representative Jim Jordan and 44 members of Congres in support of Missouri, Louisiana, and the private plaintiffs in Murthy v. Missouri, the landmark case regarding the government’s unconstitutional censorship of free speech on social media.

The brief argues that the federal government coerced private tech platforms to suppress First Amendment speech relating to the COVID-19 pandemic, Biden family influence peddling, and elections. AFL previously made similar arguments below at the Fifth Circuit on behalf of Representative Jim Jordan and other members of the House Committee on the Judiciary and the Select Subcommittee on the Weaponization of the Federal Government, and highlighted their investigative findings about the extent to which the federal government coerced private entities into censoring Americans’ speech—in particular with records from “The Facebook Files.”

The Supreme Court brief further supplements the Court’s record with their latest investigative findings about the federal government’s funding of research and tools to enable censorship at scale and the recent explosive records from “The Amazon Files,” which indicated that Amazon bowed down to Biden White House pressure to censor books:

America First Legal has long defended freedom of speech, uncovering collusion between tech companies and the government to silence Americans and suing the architects behind the censorship industrial complex, among a flurry of other critical legal actions.

America First Legal is proud to represent the following members of Congress from the U.S. Senate and U.S. House of Representatives:

Statement from America First Legal President Stephen Miller:

“America First Legal is honored to file this brief on behalf of Chairman Jordan and 44 other members of Congress. There is no greater threat to our freedom in America today than mass censorship made possible by the unholy collision between Big Government and Big Tech. AFL has been at the forefront of this battle: including by revealing the first evidence of government censorship as a result of one of our FOIA investigations, and our own critical lawsuit against third parties who appear to have played an instrumental role in the government’s censorship enterprise. We will never waver in our legal battle to restore freedom in America and stop the repressive forces of censorship,” said Stephen Miller.

Statement from Representative Jim Jordan (OH-04), Chairman of the House Judiciary Committee:

“The First Amendment is first for a reason. Through our constitutional oversight, we have uncovered evidence that the Biden Administration directed and coerced Big Tech companies to censor content online and even books. With the Supreme Court set to hear one of the most important free speech cases in years, 45 Senators and Representatives filed this brief to share Congress’s findings and urge the Court to uphold the free speech rights of American citizens” said Chairman Jordan.
