America First Legal Calls for Federal and State Investigations into Kenyon College for Illegally Forcing Students to Share Restrooms with the Opposite Sex

WASHINGTON, D.C. – Today, America First Legal (AFL) urged the U.S. Department of Education’s Office for Civil Rights and Ohio Attorney General Dave Yost to investigate Kenyon College for violating Ohio law and Title IX of the Education Amendments of 1972 by forcing female students to share restrooms with men.

On February 12, 2025, Kenyon President Julie Kornfeld and top administrators issued a statement saying, “[t]he law prohibits Kenyon from knowingly permitting members of the ‘male biological sex’ to use multi-occupancy student restrooms, locker rooms, changing rooms or shower rooms designated for use by members of the ‘female biological sex,’ and vice versa.” However, Kenyon declared that no changes would be made to multi-occupancy restrooms in administrative and academic buildings on campus, claiming that these restrooms “are not considered student restrooms within the meaning of the Ohio law, as they are not, and cannot be, designated for use exclusively by students.”

Kenyon’s policy forces women to share intimate facilities in all academic and admissions buildings on campus with men. 

Kenyon’s policy directly violates:

  • Ohio law, which explicitly prohibits academic institutions from constructing, establishing, or maintaining a multi-occupancy restrooms that are not designated for either men or women. Ohio Rev. Code Ann. § 3319.90(B)(3).
  • Title IX of the Education Amendments of 1972, which prohibits colleges and universities receiving federal funding from discriminating on the basis of sex.
  • President Trump’s Executive Order 14168, “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government,”  which establishes that there are only two sexes, male and female, and that intimate spaces are determined by biological sex, not by “identity,” and must be designated accordingly.

AFL will always fight to protect American women and girls from radical, immoral, and illegal gender ideology policies, and hold colleges and universities accountable for violating our Nation’s laws.

Schools of higher education should focus more on educating students rather than re-educating them into radical gender policies that require students, men and women, to share the same restrooms. It is not normal.
