City of Huntington Beach v. Gavin Newsom, et al.

Case Number: 2:24-cv-7959, C.D. CA.

Parental Rights
September 2024
Status: Ongoing
EducationParental Rights

Problem:

California Governor Gavin Newsom signed Assembly Bill (AB 1955) into law, which prohibits school districts from requiring parents to be informed if a student experiences gender confusion or chooses to transition socially at school. This law egregiously violates parental rights. The 14th Amendment guarantees parents the right to make decisions about the upbringing of their children. AB 1955 allows the government to intervene directly in the relationship between a parent and child. This government intrusion ignores a parent’s right to act in the best interest of their child.

Action:

America First Legal (AFL) partnered with Schaerr Jaffe LLP to file a lawsuit on behalf of a group of California parents and the City of Huntington Beach, California, against Governor Gavin Newsom, Attorney General Robert Bonta, and the State Superintendent of Public Instruction, Tony Thurmond, for violating parental rights through Assembly Bill 1955 (AB 1955).

Result:

This case is currently being litigated.
