
WASHINGTON, D.C. – America First Legal (AFL) has secured a major victory in the fight to protect women’s rights and uphold the rule of law. Kenyon College in Ohio has terminated its illegal policy that forced female students to share restrooms with men, following AFL’s federal and state complaints challenging the school’s policy for violating Title IX of the Education Amendments of 1972 and Ohio law.
On March 12, 2025, AFL filed formal complaints with the U.S. Department of Education’s Office for Civil Rights and Ohio Attorney General Dave Yost, urging investigations into Kenyon College for violating federal and state laws by forcing female students to share multi-occupancy restrooms with men.
AFL’s complaints alleged that Kenyon College had initially, incorrectly, interpreted the Ohio law to apply to student restrooms, primarily in residence halls and athletic facilities, and stated its intent to maintain gender-neutral multi-occupancy restrooms in academic and administrative buildings. However, the law is clear, prohibiting all multi-occupancy gender-neutral restrooms anywhere on campus.
After AFL sent its complaints, the Ohio Attorney General’s Office contacted Kenyon College regarding its restroom policy, reminding the school of its obligations under Ohio law.
Kenyon College has updated its compliance statement “to reflect clarification from the Ohio Attorney General’s Office,” declaring that “[t]he law applies to multi-occupancy facilities anywhere on campus that a student may use.”
Kenyon College will now label all multi-occupancy restrooms exclusively for either men or women, ensuring that women will no longer be forced to share restrooms with men on campus.
