WASHINGTON, D.C. – Today, America First Legal (AFL) filed a Freedom of Information Act (FOIA) request with the Federal Bureau of Investigation (FBI) regarding Scott McMillion, the FBI’s Chief Diversity Officer, from April 2021 to April 2023. As Chief Diversity Officer, Mr. McMillion directed the FBI’s Office of Diversity and Inclusion.
Between FY 2018 and May 2023, during Mr. McMillion’s tenure, the FBI increased “racial/ethnic diversity” by 5.4% and the proportion of female employees by 4.1%.
While tracking these statistics, the FBI “prioritizes meeting diversity goals” and states that “[t]here is still work to be done,” while highlighting that “Racial/Ethnic Minority Representation Across the FBI” is still lower than the 43.1% “Racial/Ethnic Minority Population” in the United States.
Mr. McMillion has stated that “diversity, equity, inclusion and accessibility is literally within [the FBI’s] DNA.” He has stated that diversity is one of the FBI director’s priority initiatives. Under his tenure, the FBI has sought to do “a cultural shift.” Programs like the Beacon Project aim to racially gerrymander the FBI and unlawfully infuse race, color, and national origin into hiring.
Mr. McMillion’s statements, combined with the FBI’s diversity goals and initiatives, show that the FBI likely engages in unlawful and unconstitutional racial balancing.
This conduct is patently illegal under Title VII of the Civil Rights Act of 1964. The FBI is supposed to be in the business of enforcing federal law, not ignoring it. America First Legal will continue fighting to hold the FBI accountable.

“The FBI was once an elite law enforcement agency. However, politicized leadership disgraced the institution by making it a vehicle for the Clinton Campaign’s “Russia collusion” hoax. Now, politicized leadership has adopted the Biden Administration’s woke racism to warp the Bureau’s hiring and promotion policies. The FBI’s focus should be law enforcement, not law-breaking; its immoral and illegal racial bean-counting must be exposed and ended,” said Reed D. Rubinstein.
