WASHINGTON, DC — Today, America First Legal (AFL) partnered with the State of Texas to file a lawsuit and a motion for a preliminary injunction against the Biden Administration’s plans to terminate Title 42 on May 23, 2022.
The Biden Administration’s disastrous open border policies and its confusing and haphazard COVID-19 response have combined to create a humanitarian and public safety crisis on our southern border.
Without justification or concern for Texans, the Biden Administration unlawfully disregarded the APA’s notice-and-comment requirements, refused to consider numerous factors of crucial importance when deciding to terminate Title 42, and laid bare the incoherence of their decision-making. For example, at the same time the Biden Administration decided to terminate Title 42, it has maintained a vaccine requirement for those individuals coming to the United States lawfully. In other words, one set of rules for individuals following the rules, and another set of rules for illegal aliens. Moreover, the Biden Administration failed to account for the interests of the State of Texas, which will bear the burden of the increased costs associated with the arrival of aliens into the United States–a fact that the Administration acknowledges will happen, but apparently does not care about.
