WASHINGTON, D.C. – Yesterday, America First Legal (AFL), with co-counsel Christopher Mills, filed an amicus brief in the U.S. Court of Appeals for the Fifth Circuit in State of Louisiana, et al. v. United States Department of Education, et al., arguing that the Biden-Harris Administration’s attempted redefinition of “sex” as “gender identity” is an unlawful attack on the rights of American women.

Title IX of the Civil Rights Act explicitly prohibits discrimination “on the basis of sex” in educational institutions receiving federal funding. For over fifty years, “sex” was understood to mean biological sex, male or female; Title IX was passed to protect and provide equal opportunity for women and girls. However, the Biden-Harris Administration is attempting to rewrite Title IX through an administrative rule requiring schools to define “sex” as “gender identity,” thereby opening up girls’ locker rooms, bathrooms, and sports teams to any biological male who claims to identify as a female. If this radical rule is allowed to stand, then women and girls will be stripped of opportunities and deprived of private spaces like bathrooms and locker rooms, endangering their physical safety.

On September 6, 2024, AFL filed a similar brief in Tennessee to protect biological sex from gender lunacy. On April 29, 2024, AFL and Texas Attorney General Ken Paxton filed a lawsuit against the Biden-Harris Administration to stop its outrageous assault on America’s women and girls.

AFL will keep fighting the efforts of the Biden-Harris Administration and its radical leftist allies to erase biological reality and destroy Title IX.
