America First Legal Urges Supreme Court to Enforce Federal Anti-Discrimination Law and Prohibit Harvard from Using Race In Admissions

WASHINGTON, D.C. – This week, America First Legal (AFL) filed a brief urging the Supreme Court of the United States to enforce federal anti-discrimination law as written and prohibit race-based admissions at universities that accept federal funds. 

For nearly 60 years, federal anti-discrimination statutes have clearly and unambiguously prohibited all forms of racial discrimination at universities that receive federal funds, with no exceptions for affirmative action or other diversity initiatives. Yet Harvard and other universities have been flouting this statutory command by pretending that federal anti-discrimination statutes do not mean what they say. 

The words of Title VI of the Civil Rights Act of 1964 are clear, unambiguous, and absolute: 

No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.

Harvard admits that it receives federal funds, and it openly acknowledges that it uses race as a factor in its undergraduate admissions decisions, with the conscious aim of increasing the number of “underrepresented” minorities and decreasing the number of “overrepresented” racial groups such as Asian-Americans. These racially motivated admissions practices are a clear violation of Title VI, which protects Asian-Americans from racial discrimination on the same terms as everyone else. 

The Court must enforce the statute as written and demand that Harvard either stop using racial preferences or forgo federal funds.
