What's at Stake

The University of California is using race-based preferences in its admissions process, violating both California’s Proposition 209 and the U.S. Supreme Court’s 2023 ruling in Students for Fair Admissions v. Harvard. Under the label of “holistic review,” the system gives preference to applicants based on race, sex, or national origin, often at the expense of more qualfied white and Asian students.

America First Legal (AFL), alongside co-counsel Jonathan F. Mitchell, is suing the University of California to stop these unconstitutional practices and enforce race-neutral admissions. This case seeks to restore meritocracy in public universities.
