Problem:

During the public comment portion of a Loudoun County School Board meeting on October 8, 2024, parents expressed concern through public comment about reports of an illegal alien student with ties to the transnational MS-13 gang who had been transferred to a different school after being arrested for carrying a stolen firearm and threatening to kill a classmate. Parents who criticized the board’s actions were silenced when the school board chair repeatedly interrupted them, demanded they censor their remarks, and ultimately ended public comment prematurely. The School Board defended its actions to silence parents as an effort to “combat misinformation.” This damning admission only further solidified the unconstitutional deprivation of the parent’s First Amendment rights.

Action:

On behalf of a group of parents, AFL sued the Loudoun County School Board for silencing parents' criticism and dissenting viewpoints at school board meetings.

Result:

This case is currently being litigated.
