Problem:
Through its Diversity, Equity, and Inclusion (“DE&I”) program, Ally Financial engages in discriminatory practices by prioritizing race and gender. AFL’s client, Christopher Smith, is a veteran with more than 20 years of relevant experience who applied for a position as an intelligence manager at Ally. Instead of choosing Smith for the manager position, Ally hired him as a lower “analyst,” and chose a woman with less than one-fourth his experience for the manager position. Ally then continued to discriminate against Smith because of his status as a white male by stifling his ability to advance his career while providing these opportunities to racial minorities.
Action:
In partnership with Consovoy McCarthy, AFL filed a lawsuit against Ally for violating Smith’s Civil Rights, requesting monetary compensation and a declaratory judgment that Ally’s DE&I policies are unlawful.
Result:
This case is currently being litigated in the Western District of North Carolina.
