America First Legal and State of Iowa Lead Coalition of 14 States in Filing Amicus Brief to Defend President Trump Against Civil Litigation

WASHINGTON, D.C. – Today, America First Legal (AFL) and the State of Iowa led a coalition of 14 states in filing an amicus brief in the Delaware Court of Chancery in United Atlantic Ventures, LLC, v. Trump Media and Technology Group Corp. to request that the court hold or dismiss the case against President Trump and allow him to serve his full term without the undue distraction of civil litigation.

In January 2021, Twitter (now X) permanently suspended President Trump’s Twitter, citing alleged threats of violence after the 2020 election. In February 2022, President Trump launched Truth Social through his Trump Media & Technology Group (TMTG) to provide a platform for conservative voices who experienced censorship on Twitter and other social media platforms.

In December 2024, Trump transferred out part of TMTG’s share in the app, and United Atlantic Ventures filed a lawsuit to dispute ownership rights and board seats. 

This lawsuit is a typical commercial and corporate governance dispute. However, unlike similar disputes, one of the board members is the sitting President of the United States. 

The TMTG lawsuit was filed in February 2024 — well before President Trump won reelection and assumed the responsibilities required of the President. AFL’s brief argues that the intense demands of the presidency take precedence over business disputes.

AFL asserts that the court should dismiss the lawsuit based on the constitutional separation of powers, namely, the “principle of the President’s independent authority to control his own time and energy.” As Commander-in-Chief, President Trump must be able to keep his full focus on domestic policy and national security. 

Accordingly, AFL argues that the Delaware Court should follow its longstanding tradition of judicial restraint and decline to move this case forward until President Trump’s term is completed.

President Trump has been unduly subjected to relentless political persecution and lawfare in state and federal courts, facing more lawsuits than every President in American history combined.

As the nation’s most democratically accountable public servant, the President cannot be unwillingly distracted by the burden of defending against a lawsuit. The sovereignty of states in their own sphere is paramount. But the authority of the President is one the states cannot disturb,” said Dan Epstein.
